New Jersey security deposit law: 30 days to return it, and the penalty

How long a landlord has to return a security deposit in New Jersey, what must be sent, and the penalty, read in New Jersey Statutes Section 46:8-21.1, as explained in the State of New Jersey Truth in Renting statement.

The deadline

Within 30 days after the tenancy ends, the landlord must return the deposit with the interest earned, minus any deductions, by personal delivery, registered or certified mail.

If anything is deducted, the landlord must send an itemized list of the deductions by registered or certified mail within the same 30 days.

If you broke the lease, the 30 days start when the home is rented again or when the lease would have ended, whichever comes first.

The penalty

If the landlord does not return the deposit within 30 days, or you disagree with the deductions, you can sue for double the amount wrongfully withheld, plus court costs and reasonable attorney's fees.

What to do

Send a written demand that cites the law, by certified mail or email, and keep proof. If the landlord does not pay, you can file in small claims court in the county of the rental.
