Virginia security deposit law: 45 days to return it, and the penalty

How long a landlord has to return a security deposit in Virginia, what must be sent, and the penalty, read in Code of Virginia Section 55.1-1226.

The deadline

Within 45 days after the lease ends or you move out, whichever is later, the landlord must send a written notice itemizing any deductions, with the amount due to you.

The penalty

If the landlord willfully fails to follow this law, the court orders the return of the deposit with actual damages and reasonable attorney's fees.

What to do

Send a written demand that cites the law, by certified mail or email, and keep proof. If the landlord does not pay, you can file in small claims court in the county of the rental.
